Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Fitrah mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and the App developer.

2. Description of Service

Fitrah is a mobile application designed to assist with Islamic religious practices, including prayer times, Qibla direction, Quranic content, dhikr, duas, and flashcards. The App operates entirely on your device and does not require user accounts or internet connectivity for core functionality.

3. No Warranty and Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties that the App will be uninterrupted, secure, or error-free
  • Warranties regarding the accuracy, completeness, or reliability of any information provided
  • Warranties that defects will be corrected

4. Accuracy Disclaimer

While we strive to provide accurate information, the App relies on third-party calculations and data sources. The developer makes no representations or warranties regarding the accuracy of:

  • Prayer times and calculations
  • Qibla direction
  • Islamic dates and calendar information
  • Quranic text and translations
  • Any religious content or guidance

Users should verify all information with local religious authorities and mosques. The developer is not responsible for any decisions made based on information provided by the App.

5. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or use
  • Business interruption
  • Personal injury or property damage
  • Any damages resulting from religious practices or decisions
  • Any damages resulting from the use or inability to use the App

THE DEVELOPER'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE APP, IF ANY. IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY DAMAGES WHATSOEVER.

6. User Responsibilities

You agree to:

  • Use the App only for lawful purposes
  • Not attempt to reverse engineer, decompile, or modify the App
  • Not use the App in any way that could damage, disable, or impair the App
  • Verify all religious information with appropriate authorities
  • Accept responsibility for any decisions made based on App information

7. Voluntary Support

The App may offer voluntary support options (such as "Buy Me a Coffee" or similar features). These are optional donations and do not provide any additional features or benefits. All support payments are non-refundable and voluntary. The developer reserves the right to modify or discontinue support features at any time.

8. Intellectual Property

The App and its content, including but not limited to text, graphics, images, and software, are owned by the developer and are protected by copyright and other intellectual property laws. You may not copy, distribute, or create derivative works without explicit permission.

9. Third-Party Content

The App may include content from third-party sources, including open-source packages like Adthan for prayer calculations. The developer does not claim ownership of third-party content and is not responsible for its accuracy or availability.

10. App Store Terms

These Terms are in addition to any terms imposed by the Apple App Store. In the event of a conflict, the App Store terms shall govern to the extent required by Apple.

11. Modifications to Terms

The developer reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the App after any changes constitutes acceptance of the new Terms. It is your responsibility to review these Terms periodically.

12. Termination

The developer may terminate or suspend your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App ceases immediately.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of the United States.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

15. Entire Agreement

These Terms constitute the entire agreement between you and the developer regarding the use of the App and supersede all prior agreements and understandings.
